RIVERINA DANCE CAPITAL PTY LTD 2026 TERMS, INDEMNITY & PARTICIPATION AGREEMENT

Effective from: 1 January 2026
Applies to: All students, parents/guardians, and participants of Riverina Dance Capital Pty Ltd (“RDC”).

By enrolling, signing below, or attending classes, you confirm that you have read, understood, and agreed to the following Terms & Conditions and Indemnity Agreement. Attendance at classes will also be taken as implied acceptance of this agreement.

1. MEDICAL INFORMATION & STUDENT SAFETY To support student safety, parents/guardians must:

• Disclose all medical conditions, limitations, injuries, disabilities, allergies, asthma or anaphylaxis at the time of enrolment.

• If no information is disclosed, students will be considered medically fit and able to participate.

• Provide copies of Asthma or Anaphylaxis Action Plans via email to riverinadancecapital@gmail.com, received at annual enrolment. Please assume we haven’t received it, unless we confirm via email.

• Ensure all required medications (puffers, preventers, EpiPens etc): • Are clearly labelled, • Are brought to every class or event, • Are accompanied by a physical action plan, • Are handed to an RDC teacher or representative at the start of class.
Failure to disclose medical information limits RDC’s ability to provide appropriate support and releases RDC from responsibility related to undisclosed conditions. 

2. PARTICIPATION & RISK AWARENESS Dance is a physical activity and carries inherent risks. I understand that:

• Participation is voluntary

• Students must work within their own physical limits

• Accidents or injuries may occur despite reasonable care

• Teachers provide guidance, correction, and support, but cannot prevent all injuries.

3. LIABILITY WAIVER & ASSUMPTION OF RISK I acknowledge and agree that:

• Participation in all RDC activities is at my/my child’s own risk.

• I release Riverina Dance Capital Pty Ltd, its directors, teachers, employees, contractors, assistants, volunteers, and representatives from all liability for accidental injury, illness, or demise arising from participation in: • Classes Concerts • Rehearsals • Workshops • Performances • Competitions • Exams • Events • On-site or off-site activities associated with RDC

• Nothing in this agreement excludes, restricts, or modifies any rights or remedies available under Australian Consumer Law. I accept full responsibility for my/my child’s participation.

4. SUPERVISION & RESPONSIBILITY LIMITS I understand that:

• Students are supervised during scheduled class time only

• RDC does not provide supervision: • Before or after classes • Between classes • In waiting areas • In bathrooms or change rooms • In car parks.

• If a child is left early, waits between classes, or remains after class, this is done at thparent/guardian’sown risk. If only one student remains on site with an RDC teacher, parents/guardians may be asked to wait with the teacher and child until collection occurs, in line with child safety policies.

5. PICK-UP, DROP-OFF & CAR PARK SAFETY For safety reasons:

• Students under 18 must be escorted on foot to and from the studio door. Please do not wait in the car park. We have an allocated gated area for safety.

• Students must not run across car parks or roads to waiting vehicles

• No vehicles are to wait or stop outside marked parking bays. Please do not use car parks allocated to neighbouring businesses and residents

• RDC is not responsible for accidents, injuries, theft, or incidents occurring in the car park or surrounding areas. If a student under 18 is permitted to leave the studio without a parent/guardian, written permission must be provided to riverinadancecapital@gmail.com.

Attendance at RDC is conditional upon acceptance of this policy. Please no late pickups unless an emergency or previously organised

6. WAITING AREAS: RDC provides designated waiting areas for students and parents. I understand that:

• Waiting areas are not supervised

• They are used at the student/parent’s own risk

• Noise must be kept to a minimum out of respect for classes in progress. Classes in session are not to be interrupted

• RDC is not responsible for loss, injury, theft, or damage occurring in waiting areas Only one parent/guardian per student should remain on site unless otherwise required.

7. CHANGE ROOMS & TOILETS I acknowledge that:

• Change rooms and toilets are for RDC students, staff, and guardians only

• These areas are not directly supervised

• Shower facilities are not in use

• Mobile phones or recording devices are strictly prohibited

• RDC is not responsible for loss or damage to belongings left in these areas. Parents are encouraged to remain on site for younger students if bathroom assistance may be required. 

8. PHOTOGRAPHY, MOBILE PHONES & SECURITY CAMERAS

• RDC may take photos or videos of students for educational or promotional purposes unless you tell us otherwise in writing at riverinadancecapital@gmail.com.

• Photos or videos may appear on social media, our website, flyers, or other promotional material.

• Parents and students are not allowed to take photos or videos at RDC classes or events.

• Mobile phones are not to be used in studios, waiting areas, bathrooms, or change rooms.

• Security cameras are in use in the studio to keep students and staff safe. Footage is only used for safety and security purposes. These rules are part of RDC’s commitment to keeping children safe. 

9. CHILD SAFETY RDC is committed to providing a safe, respectful environment for all students. Ensuring all children feel safe, happy and valued. I agree to:

• Respect all child safety policies

• Support appropriate behaviour, access, and supervision procedures. All RDC staff are expected to adhere to Child Safe Standards ⸻

10. CLASS EXPECTATIONS I understand and agree that:

• Students are expected to arrive on time and behave respectfully

• Bullying of any kind will not be tolerated

• Correct studio uniform and footwear must be worn

• No jewellery is to be worn in class or performances

• Only water is permitted in studios. Strictly no nuts, seafood or messy snacks

• Consistent attendance is important, particularly for concerts, exams, competitions, and performances Parents/guardians are not permitted to interrupt classes in session.

11. FEES & ENROLMENT TERMS

• Enrolment is compulsory for all students. An annual re enrolment fee of $40 will be billed for existing students and $50 for new students

• Class fees are billed per School term and must be paid within 14 days of invoice

• No refunds are given for non-attendance or change of mind

• Makeup classes may be requested where appropriate

• Late payments may incur a late fee ($20 per fortnight overdue) if payment plans are not arranged

• Private lessons cancelled within 24 hours incur a cancellation fee. 

12. COPYRIGHT & CHOREOGRAPHY I acknowledge that:

• All choreography taught at RDC is protected by copyright

• Choreography must not be recorded, shared, or used outside RDC without written permission

13. PRIVACY POLICY RDC collects and uses personal information (such as contact details, health information, and enrolment data) in accordance with the RDC Privacy Policy.

• This information is used to manage enrolments, student safety, and communications

• Personal information will not be shared with third parties except as required by law

• Parents and students may request access or corrections to their personal information at any time A full copy of RDC’s Privacy Policy is available on request

14. GOVERNING LAW This agreement is governed by the laws of New South Wales, Australia.

15. CONFIRMATION OF UNDERSTANDING I confirm that:

• I have read and understood this agreement

• I have had the opportunity to ask questions
